ABSTRACT

Out of the fifty states within the United States, forty-three have altered their laws to allow their judges to try juveniles as adults in the adult court system, but of those forty-three states Florida leads the pack by far. Florida is one of the fifteen states within the United States that allows for its Prosecutors to decide whether or not a juvenile is tried in a juvenile or adult court for a crime they have committed. have shown that there are more cases of juveniles reoffending later in life when tried as an adult and sent to adult penitentiaries, than juveniles who were tried as minors and dealt with inside the juvenile justice system. These statistics show Florida�s overall crime control impact has resulted negatively in recidivism, primarily due to the amount of juveniles who are tried and convicted as adults after committing delinquency. National averages also illustrate how when comparing Florida with the rest of the nation, their recidivism rates are higher in every aspect. Most believe that these statistics are due to the amount of power given to the prosecutors to decide whether a juvenile is tried as an adult, the amount of juveniles sentenced in adult penitentiaries, and the lack of implementation of programs that focus on helping the juvenile learn from their mistakes, rather than just do time for their actions.
